Hi I recently came out of a trust deed in July a long 4 years but got there , when I check my credit report it says on some account in default but I have 1 in particular that says in arrears and every month is coming up as a missed payment so obvious effecting chances to get a better credit rating is this correct as unsure. Any advice or knowledge would be grateful thank you

Welcome to the trust deed forum Endgame1987.

I think sections (06) and (07) of the following article may help you with understanding this and how to get it fixed:

In short, your credit file should reflect the reality that this creditor cannot any longer expect payment from you.

You may wish to complain to the lender in order to start the process of getting this fixed.

I have complained to the company and they said it should say this on my credit report they were not helpful at all

OK Endgame1987.

If you've complained to the company and you're unhappy with the response, the next step is to take your complaint to the Financial Ombudsman Service.

Because this is a data protection and data accuracy matter, you could also raise your concerns with the Information Commissioner.

Both of these bodies will be able to intervene on your behalf if they agree that the lender is in the wrong.

Hello

am due to hopefully be discharged this month! can i ask what credit company you could see these defaults on as i think i may have similar but only shows with one credit file and not the other ? thanks

Hi lilone,

I think you're probably aware already, but this kind of credit reporting is pretty standard until after you have been discharged.

Sadly quite a few firms don't seem to respond very quickly in updating credit records once discharge has been provided. Many people need to give some of their creditors a gentle nudge (and sometimes a very firm nudge!) to get their credit file properly updated.

sorry i meant which credit company did this show the defaults as in equifax or total money- credit karma etc as my credit report shows different items with each so i just wondered

ill be sure to look into it once i get the discharge :)

Hi I use credit karma and clearscore clearscore seems to be better one for me personally to use. Thanks for the help much appreciated

Hi Endgame1987,

You should formally complain to the firm first. This will mean they have to respond within a set period of time.

If you don't get a response, or if you disagree with the response, you can escalate the complaint.

The Financial Ombudsman Service would be the usual place to take a complaint about a lender.

You could also report the matter to the Information Commissioner's Office as this is (in part) a data protection issue.

Hi Amy thought would update I got a response from Company who say I owe them 110 pounds would this be correct I thought after discharged I wouldn't have to pay anymore fees

They can't look for repayment of any charges or interest that they have added on to a debt which was included in the Trust Deed. Hopefully if you reply to point this out then it will be looked at by someone who understands the law better and sorts it out for you. If not then you might have to escalate the complaint.

Yes it seems strange the arrears payable Is 109.60 but the current balance is 164.40. No idea where these numbers have came from it also says will continue to send notices. Bit worried will effect credit report again
