Hi, my Dad was delivered a charge of payment for £8900 yesterday, he has 14 days to pay this but he doesn’t have £8900, and has nowhere near this.

This was for a car that was repossessed last June .


Would he be able to enter into a trust deed? He is 63. He also has a car on finance but he does pay this every month so would this be able to be left out of the trust deed?

He doesn’t want his wages to be arrested and is panicking a lot #128546;

Welcome to the forum Chelsea202.

I'm sorry to hear that your dad finds himself in this worrying position.

The key point here is that he should obtain professional debt advice ASAP. There are things that can be done to protect his position but that will need to happen quickly.

A trust deed is one of the debt solutions that might suit his needs (and this debt would be included) but there are other solutions which could turn out to be a better fit depending upon a number of factors.

The debt solution is really the second stage of an action plan here though. The first is to get advice and protect his position now so he has time to consider a longer-term plan to deal with this and any other debts that he might have.

It's usually much easier and much faster by telephone Chelsea202.

We're open to communicating by email, but I wouldn't really recommend it unless there's a good reason to avoid speaking on the phone.

Phone is perfect, he is working today but can call you tomorrow? Would you recommend him phoning the place that was dealing with the problem and seeing if they’ll accept a payment plan? I think it’s Mitchell Roberton in Glasgow.

I think the first stage is to quickly get debt advice.

The outcome of that debt advice might be to contact the firm concerned about a payment plan, or it might be something really quite different.

Once the charge of payment has expired, it allows creditors the opportunity to consider action for recovery. The good news is that there are solutions available and we will be able to help.
