I got the same reply from the FO as everyone else has been getting, disappointing really although heartened by the previous post to this by Luke4630

I raised a case with RBS in August this year, and got a reply. Originally in 2012 they paid £8359.24 which was statutory interest, the rest £5534.99 they set off against arrears. They contacted me and said they could find no record of claims. This week i received a detailed breakdown comprehensive of all that has happened with each account and claim.
Firstly from saying they had nothing , to every record was interesting. In my latest claim i stated that i was claiming based on the looming court case.
Low and behold they have found in one of the original cases they missed an offer of £1511.38 and in another £6135.28.
Great i thought, then there follows 4 cleavrely and deviously written paragraphs where i feel they are wanting me to accept the offers, however with the possibility of them being set off!
Again i think they are wanting me to accept as the case if RBS dont win it, will mean they will be due me more.
I WILL NOT be signing anything until after the case is heard, as if i do i will fall fowl of the FOS ruling that the RBS can set off.

I have read through both the Mond and Dooneen judgements. There have been a lot of Judges/QC,s Lords coming to the same decision. It would seem that they are all saying the same thing, once discharged there is no claim under law to set off.
All very interesting.
I hope this is a done deal. Will make a great Xmas for me if it is!

I think there's been some speculation here that this case (like Mond) was due to be held at the Supreme Court. It's seems that this isn't the case, so a route of appeal 'may' remain available to whichever side loses on this occasion.

I disagree slightly with Kayak's point about judges reaching the same conclusion. The reason that both of these cases have gone so far has been that judges have reached different conclusions. Both cases are also actually about really quite different legal points.

Let's hope this case brings the whole subject to a close and everyone knows where they stand though. It's all gone on for far too long.
